Where information is optional (such as a profile photograph or gender), we will indicate this, and you may choose not to provide it without affecting your access to the Services.

5.3 Information about other persons. If you provide us with personal information about another person (for example, an emergency contact or a person for whom you purchase a gift voucher), you confirm that you are authorised to do so and that you have informed that person of this Privacy Policy.

6. SPECIAL PERSONAL INFORMATION: HEALTH AND MEDICAL INFORMATION

IMPORTANT – PROCESSING OF YOUR HEALTH INFORMATION

Health information is special personal information under section 26 of POPIA and is subject to additional protection. We process your health information only with your explicit consent (or as otherwise permitted by POPIA) and only for the purposes of ensuring your safety during Classes and Private Sessions, adapting exercises to your needs and responding to emergencies. You may withdraw your consent at any time, but this may mean that we cannot safely allow you to participate in Classes.

6.1 Why we collect health information. Reformer pilates and related activities involve physical exertion and the use of spring-loaded equipment. To enable our Instructors to provide safe, appropriate instruction and modifications, and to respond properly in the event of an injury or medical emergency, our Terms and Conditions require you to disclose relevant medical conditions, injuries, pregnancy, surgeries, medications and changes in your health before and while participating in the Services.

6.2 What we collect. The health information we may collect includes: responses to our Health Questionnaire; information about current and past injuries, medical conditions, surgeries and medications; pregnancy and post-natal status; physical limitations and mobility; medical clearance letters or certificates; notes made by Instructors regarding modifications required for your safety; and incident and injury reports.

6.3 Lawful basis – explicit consent (sections 26 and 27 of POPIA). Section 26 of POPIA prohibits the processing of special personal information unless a general authorisation in section 27 (or a specific authorisation in sections 28 to 33) applies. We rely primarily on your explicit consent in terms of section 27(1)(a) of POPIA. We obtain this consent through a separate, clearly worded consent mechanism (such as an unticked checkbox) when you complete the Health Questionnaire in the App, on the Website or at the Studio. We may also process health information where it is necessary for the establishment, exercise or defence of a right or obligation in law, in accordance with section 27(1)(b) of POPIA (for example, in connection with an incident report or a legal claim).

6.4 Minors. Where the data subject is a child, we will process health information only with the prior consent of a competent person (such as a parent or legal guardian), in accordance with sections 27(1)(a) and 35 of POPIA.

6.5 How we use it. We use health information only to: (a) assess whether it is safe for you to participate and whether medical clearance is required; (b) enable Instructors to modify exercises and select appropriate Classes; (c) respond to injuries and medical emergencies, including by sharing relevant information with emergency medical personnel; (d) record and investigate incidents; (e) process medical-related membership freezes or credits; and (f) establish, exercise or defend legal rights.

6.6 What we do not do. We do not use your health information for marketing or advertising, we do not sell it, we do not share it with analytics or advertising providers, and we do not use it to make automated decisions about you.

6.7 Access restrictions. Access to health information is strictly limited to authorised personnel who need it to perform their functions (for example, the Instructor teaching your Class and Studio management), each of whom is subject to confidentiality obligations. Health information is stored with additional access controls within our systems.

6.8 Withdrawal of consent. You may withdraw your consent to the processing of your health information at any time by emailing Reformandglow0@gmail.com or by using the relevant setting in the App (where available). Withdrawal will not affect the lawfulness of processing before withdrawal. Please note that, because the disclosure of relevant health information is a safety requirement under our Terms and Conditions, withdrawal of consent may mean that we are unable to allow you to participate in Classes or Private Sessions. We may retain records such as incident reports where we are entitled to do so under section 27(1)(b) of POPIA or other law.

6.9 Other special personal information. We do not intentionally collect other categories of special personal information (such as religious beliefs, race or ethnic origin, political persuasion or biometric information). Please do not provide such information to us unless we specifically request it for a lawful purpose. If we introduce any biometric check-in or similar feature, we will update this Privacy Policy and obtain your explicit consent beforehand.

7. HOW WE COLLECT PERSONAL INFORMATION

7.1 Directly from you. We collect most personal information directly from you, for example when you: download the App and register an Account; complete your profile or the Health Questionnaire; make a Booking or purchase; check in at the Studio; communicate with us by email, WhatsApp, telephone, in-app messaging or social media; complete a survey, competition entry or feedback form; subscribe to our newsletter; or attend the Studio.

7.2 Automatically. When you use the App or Website, we and our third-party service providers automatically collect certain device and usage information through software development kits ("SDKs"), cookies and similar technologies, as described in clauses 12 and 13.

7.3 From third parties. We may receive personal information about you from third parties, including: Payfast (payment confirmations and transaction references); Apple or Google (if you use Sign in with Apple, Google Sign-In or in-app purchases, and aggregated statistics relating to App downloads); a person who purchases a gift voucher or class package for you, or who refers you; your employer or a corporate wellness partner (if you participate through a corporate programme); and social media platforms (if you interact with our pages or link your social media account).

7.4 From public sources. We may collect information that you have made publicly available, such as public comments or reviews about Reform and Glow on social media or review platforms.

7.5 In accordance with section 12 of POPIA, where we collect personal information from a source other than you, we will do so only where permitted by POPIA (for example, where the information is contained in a public record, where you have consented, or where collection from another source is necessary for a lawful purpose).

8. PURPOSES OF PROCESSING AND LAWFUL GROUNDS

8.1 We process your personal information only for specific, explicitly defined and lawful purposes, and only where one or more of the lawful grounds in section 11(1) of POPIA applies. These grounds are: (a) your consent; (b) processing is necessary to carry out actions for the conclusion or performance of a contract to which you are a party; (c) processing complies with an obligation imposed by law; (d) processing protects your legitimate interest; or (f) processing is necessary for pursuing our legitimate interests or those of a third party to whom the information is supplied. We may de-identify or aggregate personal information so that it can no longer be used to identify you, and use such de-identified information for statistical, analytical and business-planning purposes. De-identified information is not personal information under POPIA.

9. CONSENT AND WITHDRAWAL OF CONSENT

9.1 Where we rely on your consent, that consent will be voluntary, specific and informed. We will request it separately from your acceptance of our Terms and Conditions (for example, by means of an unticked checkbox or a toggle in the App) and will record when and how it was given.

10. DIRECT MARKETING

10.1 We may use your personal information to send you information about our Classes, memberships, promotions, events, workshops and other products and services that may be of interest to you, subject to section 69 of POPIA and the Consumer Protection Act 68 of 2008.

10.2 Existing customers. Where you are an existing customer and we obtained your contact details in the context of the sale of a product or service, we may send you electronic direct marketing (for example, by email, SMS or push notification) relating to our own similar products or services, provided that you were given a reasonable opportunity to object, free of charge and without unnecessary formality, when your details were collected, and that you are given the opportunity to object on each occasion that we send you a marketing communication, in accordance with section 69(3) of POPIA.

10.3 Non-customers. Where you are not an existing customer, we will send you electronic direct marketing only if you have given your prior consent. We will approach you for your consent only once, and only if you have not previously withheld such consent, in accordance with section 69(2) of POPIA.

10.4 Opting out. Every direct marketing communication we send will contain our details and an easy method for you to opt out (unsubscribe). You may opt out at any time by: (a) clicking the "unsubscribe" link in any marketing email; (b) replying "STOP" to marketing SMS or WhatsApp messages, where offered; (c) disabling marketing push notifications in the App or in your device settings; or (d) emailing Reformandglow0@gmail.com. 11. SHARING OF PERSONAL INFORMATION AND OPERATORS

11.1 We do not sell your personal information. We share personal information only to the extent necessary for the purposes described in this Privacy Policy, and only with the following categories of recipients:

11.2 Operator agreements. In accordance with sections 20 and 21 of POPIA, we require all operators that process personal information on our behalf to do so only with our knowledge and authorisation, to treat the information as confidential, and to establish and maintain appropriate security safeguards. Where an operator is not bound by standard terms that already meet these requirements, we will conclude a written agreement with it. Operators must notify us immediately if they have reasonable grounds to believe that personal information has been accessed or acquired by an unauthorised person.

11.3 Some third-party service providers (for example, Apple, Google and Payfast) also act as independent responsible parties in respect of certain personal information they collect directly from you, and their processing is governed by their own privacy policies.

12. THIRD-PARTY SERVICES AND PLUGINS

12.1 The App and Website use, or may use, the third-party services, software development kits (SDKs) and plugins described in this clause 12. Some of these services are confirmed as part of our technology stack, while others are services that we may use from time to time to operate, support or improve the Services. These providers may process your personal information as our operators or, in some cases, as independent responsible parties. Each provider's processing is also governed by its own privacy policy, which we encourage you to read.

12.2 We select reputable providers, configure their services to limit data collection to what is reasonably necessary, and (where they act as our operators) require them to protect your personal information in accordance with POPIA. Many of these providers are located outside South Africa, and the transfer of personal information to them is subject to clause 15.

12.3 Google Analytics and Google Analytics for Firebase (app performance and usage analytics). (a) Information collected: app-instance identifiers, device model, operating system and version, app version, language, country and approximate region (inferred from IP address), first-open and session data, screens viewed, in-app events (such as bookings started or completed), engagement time, and, where permitted by your device settings, advertising identifiers.
  2. (b) Purpose: app performance and usage analytics, understanding user journeys, identifying popular features, and improving the design and functionality of the App.
  3. (c) Safeguards: we do not send your name, email address, telephone number or health information to Google Analytics; we configure data-retention and data-sharing settings to limit processing; and we do not use Google Analytics data to identify you personally.
  4. (d) Your choices: you can limit ad tracking or reset your advertising identifier in your device settings (for example, "Allow Apps to Request to Track" on iOS, or "Delete advertising ID" on Android). On the Website, you can manage analytics cookies through our cookie banner (where applicable) or install the Google Analytics opt-out browser add-on.
  5. (e) Further information: https://policies.google.com/privacy and https://firebase.google.com/support/privacy.

12.4 Payfast (online payment processing). We use Payfast, a third-party online payment gateway, to process payments for packages, memberships, Private Sessions and other Services made through the App or Website.

  1. (a) Information collected: when you make a payment, you are directed to Payfast's secure payment page or interface, where Payfast collects your card details (card number, expiry date and CVV) or banking details, together with your name, email address, transaction amount and reference.
  2. (b) Card details are handled by Payfast, not by us: your full card and banking details are captured, processed and stored by Payfast in accordance with the Payment Card Industry Data Security Standard (PCI DSS). Reform and Glow (Pty) Ltd does not receive, see or store your full card number, CVV or banking passwords. We receive only limited information from Payfast, such as the transaction status, amount, date, a transaction reference and, for recurring billing, a payment token or subscription reference and (in some cases) a masked card number (e.g. the last four digits) and card type.
  3. (c) Purpose: processing payments, recurring membership billing, refunds, fraud prevention and financial record-keeping.
  4. (d) Further information: Payfast's privacy policy is available at https://payfast.io/privacy-policy/.

  1. (a) Information collected: a push notification token, a OneSignal player or subscription identifier, device type and model, operating system, app version, language, time zone, approximate location inferred from IP address, session count and last-active time, notification delivery and open data, and, where we configure it, an external user identifier or tags (such as membership type or preferred Studio) that allow us to send relevant notifications.
  2. (b) Purpose: sending booking confirmations, class reminders, waitlist updates, timetable changes, account notices and (where you have not opted out) promotional notifications, and measuring whether notifications are delivered and opened.
  3. (c) Safeguards: we do not send health information to OneSignal.

13. COOKIES AND SIMILAR TECHNOLOGIES

13.1 Our Website uses cookies, and our App uses SDKs, local storage and similar technologies (together, "cookies"), to operate, secure and improve the Services. Cookies are small data files placed on your device that allow a website or app to recognise your device and store certain information.

13.2 We may use the following types of cookies:

  1. (a) strictly necessary cookies, which are essential for the Website and App to function, such as cookies that keep you logged in, remember items in your checkout and maintain security (these cannot be switched off);
  2. (b) functionality cookies, which remember your preferences (such as language or saved settings);
  3. (c) analytics and performance cookies, such as those set by Google Analytics, which help us understand how visitors use the Website and App so that we can improve them; and

14.1 The App may request access to certain features of your device. We will request each permission at the time it is needed (where your operating system allows), and you can grant, refuse or withdraw any permission at any time in your device settings. Refusing a permission will not prevent you from using the core features of the App, although certain functions may not work.

  4. (d) Calendar (if applicable): to add your Bookings to your device calendar, only when you choose to do so.
  5. (e) App tracking transparency (iOS): if the App uses any feature that tracks you across apps and websites owned by other companies, we will request your permission through Apple's App Tracking Transparency prompt, and you may decline.

15.2 In accordance with section 72 of POPIA, we will transfer your personal information to a third party in a foreign country only if:

  1. (a) the recipient is subject to a law, binding corporate rules or a binding agreement that provides an adequate level of protection that effectively upholds principles for the reasonable processing of personal information substantially similar to the conditions for lawful processing in POPIA, including provisions relating to the further transfer of personal information;
  2. (b) you consent to the transfer;
  3. (c) the transfer is necessary for the performance of a contract between you and us, or for the implementation of pre-contractual measures taken in response to your request;
  4. (d) the transfer is necessary for the conclusion or performance of a contract concluded in your interest between us and a third party; or
  5. (e) the transfer is for your benefit, it is not reasonably practicable to obtain your consent, and if it were reasonably practicable to obtain such consent, you would be likely to give it.

15.3 Where we transfer personal information across borders, we take reasonable steps to ensure that the recipient provides adequate protection, for example by relying on providers that are subject to comprehensive data protection laws (such as the European Union General Data Protection Regulation) or that have contractually committed to data protection standards (such as standard contractual clauses or data processing terms).

15.4 Special personal information. Health information is stored with providers that apply strong security measures. Where health information is transferred outside South Africa, we will ensure that the transfer complies with section 72 of POPIA and, where required, with section 57 of POPIA (prior authorisation).

16. DATA SECURITY SAFEGUARDS

16.1 In accordance with section 19 of POPIA, we secure the integrity and confidentiality of personal information in our possession or under our control by taking appropriate, reasonable technical and organisational measures to prevent loss of, damage to or unauthorised destruction of personal information, and unlawful access to or processing of personal information.

16.2 To do so, we take reasonable measures to: (a) identify all reasonably foreseeable internal and external risks to personal information; (b) establish and maintain appropriate safeguards against the risks identified; (c) regularly verify that the safeguards are effectively implemented; and (d) ensure that the safeguards are continually updated in response to new risks or deficiencies.

16.3 Our safeguards include, as appropriate:

  1. (a) encryption of data in transit (using TLS/HTTPS) and at rest;
  2. (b) secure authentication, strong password requirements and, where available, multi-factor authentication for administrative access;
  3. (c) role-based access controls that limit access to personal information (and in particular health information) to authorised personnel on a need-to-know basis;
  4. (d) confidentiality undertakings from employees and Instructors, and data protection training;
  5. (e) use of PCI DSS-compliant payment processing through Payfast, so that card details are not stored on our systems;
  6. (f) regular software updates, security patches, monitoring and logging of access to systems;
  7. (g) secure backup and recovery procedures;
  8. (h) physical security measures at the Studio, including locked storage for any paper records such as signed health forms; and
  9. (i) contractual obligations on operators to implement appropriate security measures in accordance with sections 20 and 21 of POPIA.

16.4 While we take all reasonable steps to protect your personal information, no method of transmission over the internet or electronic storage is completely secure. You are responsible for keeping your Account login credentials confidential and for notifying us immediately at Reformandglow0@gmail.com if you suspect any unauthorised access to your Account.

17. SECURITY COMPROMISES AND BREACH NOTIFICATION

17.1 In accordance with section 22 of POPIA, where there are reasonable grounds to believe that your personal information has been accessed or acquired by any unauthorised person (a "security compromise"), we will notify:

  1. (a) the Information Regulator; and
  2. (b) you, unless your identity cannot be established,

17.2 as soon as reasonably possible after the discovery of the security compromise, taking into account the legitimate needs of law enforcement and any measures reasonably necessary to determine the scope of the compromise and to restore the integrity of our information systems.

17.3 We may delay notifying you only if a public body responsible for the prevention, detection or investigation of offences, or the Information Regulator, determines that notification will impede a criminal investigation.

17.4 Notification to you will be in writing and communicated by at least one of the following methods: email to your registered email address; notice in the App; publication on our Website or in the news media; or as directed by the Information Regulator.

17.5 The notification will provide sufficient information to allow you to take protective measures against the potential consequences of the compromise, including: (a) a description of the possible consequences of the security compromise; (b) a description of the measures we intend to take or have taken to address the compromise; (c) a recommendation of the measures you can take to mitigate its possible adverse effects; and (d) if known, the identity of the unauthorised person who may have accessed or acquired your personal information.

17.6 We maintain an internal incident response procedure, and we require our operators to notify us immediately of any security compromise affecting personal information they process on our behalf.

18. RETENTION AND DESTRUCTION OF PERSONAL INFORMATION

18.1 In accordance with section 14 of POPIA, we retain personal information only for as long as necessary to achieve the purpose for which it was collected or subsequently processed, unless: (a) retention is required or authorised by law; (b) we reasonably require the record for lawful purposes related to our functions or activities; (c) retention is required by a contract between you and us; or (d) you (or a competent person, in the case of a child) have consented to the retention.
